These Terms of Service govern your use of professional dog waste removal services provided by Scot Pooper Scoopers Limited, a company registered in Scotland, United Kingdom.

By booking our services, creating an account, or using our website and mobile applications, you acknowledge that you have read, understood, and agree to be legally bound by these terms.

Agreement to Terms

By accessing and using the services provided by Scot Pooper Scoopers Limited ('we', 'us', 'our'), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you (the 'Client') and Scot Pooper Scoopers Limited. By booking a service, creating an account, or using our website, you acknowledge that you have read, understood, and agree to be bound by these terms.

Modifications

We reserve the right to modify these terms at any time. Any changes will be posted on our website and will become effective immediately upon posting. Your continued use of our services after any modifications constitutes acceptance of the new terms.

Services Provided

Scope of Services

We provide professional dog waste removal services for residential and commercial properties across Lanarkshire, Scotland. Services include regular yard cleaning, waste disposal, sanitization treatments, and related services as agreed upon in your service package.

Service Packages

We offer various service packages including weekly, bi-weekly, and twice-weekly services. Specific services, frequency, and pricing are outlined in your service agreement and quote. Additional services may be available upon request and are subject to separate pricing.

Service Limitations

Our services are limited to dog waste removal from designated outdoor areas. We do not provide services for other types of pet waste, clean indoor areas, or handle hazardous materials. Special requests may be accommodated on a case-by-case basis.

Section 3
Client Responsibilities

Access to Property

You must provide safe and unobstructed access to all service areas. This includes providing gate codes, keys, or other access methods as necessary. You are responsible for ensuring technicians can safely access your property.

Pet Safety

You must inform us of any aggressive or protective dogs on the property. If technicians determine conditions are unsafe, we reserve the right to refuse service until safety concerns are addressed. You are responsible for restraining aggressive pets during service.

Accurate Information

You must provide accurate information about your property, number of dogs, yard size, and any special requirements. Failure to provide accurate information may result in service adjustments and additional charges.

Property Condition

You are responsible for maintaining safe property conditions. This includes securing loose objects, marking underground utilities, and notifying us of any hazards such as holes, steep slopes, or recent pesticide application.

Section 4
Payment Terms

Pricing and Billing

Service pricing is based on your selected package, property size, number of dogs, and service frequency. All prices are quoted in British Pounds (£) and are subject to change with 30 days' notice. You will receive advance notice of any price changes.

Payment Methods

We accept payment via credit card, debit card, and direct debit. Payment is processed automatically according to your billing cycle (weekly, bi-weekly, or monthly). You must maintain a valid payment method on file.

Prepayment Policy

Services are billed in advance. New clients signing up mid-month will be charged for the initial clean-up plus remaining services for that month. Subsequent billing occurs at the beginning of each billing cycle.

Late Payments

If payment fails or is not received by the due date, services will be paused until the account is current. A £5 late fee may be applied for payments more than 7 days overdue. Continued non-payment may result in account cancellation.

Refunds

Refunds are provided only for services not rendered due to our cancellation. No refunds are provided for client cancellations with less than 24 hours' notice or for dissatisfaction after service completion. See our cancellation policy for details.

Section 5
Scheduling and Cancellation

Service Scheduling

Services are scheduled based on availability and optimal route planning. While we aim to service your property on the same day each week, exact timing may vary by up to 2 hours from the scheduled window. We will notify you of any significant changes.

Rescheduling by Client

You may reschedule services with at least 48 hours' notice at no charge. Rescheduling requests with less than 48 hours' notice are subject to a £5 fee. Same-day rescheduling requests may not be accommodated.

Cancellation by Client

You may cancel individual services with at least 24 hours' notice without penalty. Cancellations with less than 24 hours' notice will be charged the full service fee. To cancel your subscription, provide 14 days' written notice.

Cancellation by Company

We reserve the right to cancel services due to severe weather, unsafe conditions, property access issues, or other circumstances beyond our control. If we cancel, you will not be charged for that service and we will reschedule at no additional cost.

Subscription Pause

You may pause your subscription temporarily (e.g., for holidays, renovations) with at least 7 days' notice. Pauses can last up to 60 days per year. During a pause, you will not be charged, but your service slot may not be guaranteed upon resumption.

Section 6
Liability and Insurance

Our Insurance

We maintain comprehensive public liability insurance and are registered with the Scottish Environment Protection Agency (SEPA). Our technicians are trained professionals committed to providing safe, quality service.

Liability for Damages

While we take every precaution to prevent property damage, we are not liable for damage to unmarked underground utilities, items left in service areas, or pre-existing property conditions. We will report any damage we discover during service.

Client Property

You are responsible for securing valuable items, marking sensitive areas (sprinkler heads, underground lines, delicate plants), and maintaining safe property conditions. We are not responsible for damage resulting from your failure to mark hazards or provide accurate property information.

Limitation of Liability

Our total liability for any claim arising from our services is limited to the total amount paid by you for services in the 30 days prior to the incident. We are not liable for indirect, incidental, or consequential damages.

Indemnification

You agree to indemnify and hold harmless Scot Pooper Scoopers Limited, its employees, and contractors from any claims, damages, or expenses arising from your breach of these terms or your negligence.

Section 7
Service Guarantee and Complaints

Quality Guarantee

We stand behind the quality of our work. If you're not satisfied with a service, contact us within 24 hours and we will return to address any issues at no additional charge. This guarantee applies only to services performed according to your package specifications.

Complaint Procedure

To file a complaint, contact us at info@scotpooperscoopers.com or call +44 07351 220237 within 48 hours of service. We will investigate all complaints promptly and work to resolve issues to your satisfaction.

Resolution Process

Most complaints are resolved within 2-3 business days. For complex issues, we may require additional time to investigate. We will keep you informed throughout the resolution process.

Section 8
Termination

Termination by Client

You may terminate your service agreement at any time by providing 14 days' written notice. You remain responsible for payment for services already rendered and scheduled services within the notice period.

Termination by Company

We reserve the right to terminate service immediately for: non-payment, repeated access issues, unsafe property conditions, abusive behavior toward staff, breach of these terms, or any reason that makes service provision impractical or unsafe.

Effect of Termination

Upon termination, you must immediately pay all outstanding amounts owed. Any prepaid amounts for services not yet rendered will be refunded within 14 days. All data and account information will be retained per our Privacy Policy.

Section 9
Property Access and Safety

Access Authorization

By using our services, you authorize our technicians to enter your property for service provision. This authorization includes photographing service areas for documentation purposes.

Safety Standards

Our technicians follow strict safety protocols. If conditions are deemed unsafe (aggressive pets, hazardous terrain, extreme weather), technicians may refuse service. You will be notified and given the opportunity to address safety concerns.

Supervision Not Required

You are not required to be home during service. However, if you choose to be present, please do not interfere with technicians performing their duties or create unsafe working conditions.

Intellectual Property

All content on our website, mobile app, and marketing materials, including text, graphics, logos, and software, is the property of Scot Pooper Scoopers Limited and is protected by UK and international copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

Communications

Service Communications

By using our services, you consent to receive service-related communications via email, SMS, app notifications, and phone calls. These include appointment confirmations, reminders, service reports, and account updates.

Marketing Communications

We may send marketing communications if you've opted in. You can opt out at any time via your account settings or by clicking 'unsubscribe' in any marketing email.

Communication Methods

You agree to maintain accurate contact information. We are not responsible for missed communications due to outdated or incorrect contact details.

Governing Law and Disputes

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Scotland and the United Kingdom. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.

Dispute Resolution

In the event of a dispute, we encourage direct communication to resolve issues amicably. If resolution cannot be reached, both parties agree to attempt mediation before pursuing legal action.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Scot Pooper Scoopers Limited regarding the use of our services.

Important Notice

By using Scot Pooper Scoopers' services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. We reserve the right to modify these terms at any time.
